These terms and conditions ("Agreement") govern your use of the services provided by HeftyDev, LLC, SalesEngineer.Direct, and Trevor Nelson ("we," "us," or "our"), including access to our websites, applications, and related resources (collectively, the "Services"). By accessing or using our Services, you agree to comply with and be bound by this Agreement.

If you are using our Services on behalf of a company or organization, you represent that you have the authority to bind that entity to this Agreement. In such cases, the terms "you" or "your" refer to both you as an individual and the organization you represent. You may not access the Services on behalf of a business entity if you lack such authority.

Accounts and Membership

You must be at least 18 years old to use our Services.
You are responsible for maintaining the security of your account credentials and for all activity under your account.
Notify us immediately of any unauthorized access or suspected breach. We are not liable for any damages caused by your failure to secure your account.
We reserve the right to suspend or terminate your account if you violate this Agreement or act in a way that harms our community, reputation, or platform integrity.

User Content

You retain ownership of any data, content, or material ("Content") you submit to the Services. You are responsible for ensuring your Content is accurate, lawful, and does not infringe on the rights of others.
By submitting Content, you grant us a non-exclusive, worldwide license to use, display, distribute, and adapt your Content for the purpose of providing, operating, and improving the Services.
We may remove Content that violates our policies, is unlawful, or is otherwise harmful or objectionable.
We do not guarantee the accuracy or completeness of any user-submitted content, including job listings or candidate profiles.

Billing and Payments

You agree to pay all fees associated with the Services as outlined at the time of purchase or subscription.
If auto-renewal is enabled, you authorize us to charge your saved payment method unless canceled before the renewal date.
All payments are non-refundable unless explicitly stated.
We reserve the right to change pricing or cancel any subscription at our discretion.
In cases of high-risk transactions, we may request identification or additional verification before completing a payment.

Candidate Bonuses

Primary Signing Bonus

If you secure employment through SalesEngineer.Direct and notify us via email or through the web application, and that hire is confirmed by the hiring manager or employer, you will receive a one-time signing bonus of $250. Confirmation must be received from both you and the employer. Payment will be issued via Stripe within 45 days of verified confirmation.
If you earn more than $600 in total bonuses from SalesEngineer.Direct in a single calendar year, you will be required to submit a completed Form W-9 before receiving additional payments. The first $600 will be paid automatically, but no further payments will be issued until a valid W-9 is received. These payments are considered taxable income, not gifts or prizes, and are reportable to the IRS. You will receive a Form 1099-NEC if your total payments meet or exceed the IRS reporting threshold for the calendar year.
We reserve the right to delay or withhold payment in cases of suspected fraud, misrepresentation, or unverified employment.

Referral Bonus

If another user secures employment through SalesEngineer.Direct and has listed you as their referral before the date of their offer letter, and both their hire and your referral are confirmed via email, you will receive a referral bonus of $250. The referred user must also meet the requirements for their own primary signing bonus in order for you to be eligible for the referral bonus.
To be eligible:
- The referred user must list you as their referrer in their profile prior to receiving a job offer.
- You must confirm the referral via a confirmation email sent to you.
- The system must show a referral record with a creation date prior to the offer letter date.
You can view all your referrals — including their names and the date the referral was recorded — at /my_referrals. Referred users can also see their listed referral on their Sales Engineer profile.
All referral bonuses are subject to the same $600 threshold, W-9 requirement, and IRS reporting rules as signing bonuses. If your total combined bonuses (signing + referral) exceed $600 in a calendar year, a W-9 will be required and a 1099-NEC will be issued.

Accuracy of Information

Information on the Services, including job listings and candidate profiles, may occasionally contain errors or omissions. We reserve the right to correct such errors at any time without notice. We are not obligated to update or verify listing details including user credentials, experience, eligibility, or legal work status.

Third-Party Links and Resources

Our Services may contain links to third-party websites or apps. These links do not imply our endorsement. We are not responsible for the content, services, or data policies of any third-party resource. Use third-party sites at your own risk.

Backups

We perform regular backups for administrative purposes but do not guarantee data recovery or completeness. Users are responsible for backing up their own data and content.

Prohibited Uses

You agree not to use the Services:

For unlawful, abusive, or fraudulent purposes
To infringe on intellectual property rights
To upload viruses or malicious code
To harass, defame, or discriminate
To engage in spam, scraping, or phishing
To interfere with the platform's security or infrastructure

Violation of these terms may result in account suspension or legal action.

Indemnification

You agree to indemnify and hold harmless HeftyDev, LLC, its owners, employees, and affiliates from any claims, damages, or legal fees resulting from your use of the Services, your submitted Content, or your violation of this Agreement.

Dispute Resolution

This Agreement is governed by the laws of the State of Utah, United States.
Any disputes will be resolved exclusively in courts located in Utah.
You waive the right to a jury trial in any legal matter related to this Agreement.

Changes to These Terms

We may update this Agreement from time to time. Changes become effective upon posting. If we make material changes, we may notify you via email or through the platform. Continued use of the Services after changes take effect constitutes acceptance of the updated terms.
